In these days of mass production, marketing, and HMOs that focus only on patient processing at the expense of minimally invasive patient treatment and care, any person who has been in the hospital for something serious (or who might be going fairly soon) should be aware of the possibilities of clinical negligence that they might encounter while committed, and their rights and responsibilities with regard to their health and care. The medical system in America these days is as complicated as it is slow, and there is a lot of legalese for a layperson to learn just to cover their basic rights when it comes to their life, liberty, and health.

One of the largest concerns of a person in the medical system, and probably the easiest to check when in the situation, is your doctor a REAL doctor, and are you getting a diagnosis by someone who knows what to look for? Make sure to have your caretaker assert that he or she is a full physician, or can provide a referral to someone who is; in many case this can be a problem, because care can be provided by TRAINEES (who are in rotations and haven't had all of the training or wide set of job experiences) that a full physician, and preferably an expert in whatever condition you are facing, has.


Listen to what the doctor (trainee or not, he or she is still an M.D.) has to say, but DEFINITELY check your options on referrals and second opinions; remember, doctors who don't run their own practices are essentially forced to process people as quickly as they can, and thus can miss things (through clinical negligence) that could cause YOU serious harm later down the road. Don't let that be you! Be aware of your rights to health care choice and referral, and go to someone who is qualify to diagnose you for excellent care!
