When you undertake the IVA, your circumstances and ability will be undertaken by the IP to maintain your monthly payments is reviewed regularly. These are normally conducted once in a year. If during these reviews, if it is found that your circumstances have not changed, then you will continue to make your monthly IVA payment as previous. If however, your circumstances have changed for the better ends, you may be asked to increase your monthly outgoing accordingly. If during the period of your IVA your circumstances becomes worse and you cannot maintain the mutually agreed payments. In such scenario, the IP can ask your creditors if they will agree to vary the terms of your proposals. If up until that time, you have maintained your payments without problem, your lenders may be mindful to accept such changes.
If you fall into difficulty and are unable to make the payments to your Individual Voluntary Agreement loan service (e.g. you lose your job), it is possible to agree a payment holiday with the consultation of the IP. The months which you miss will normally be added to the end of the agreement tenure. When you are unable to re-start your payments at all, it is likely that the IVA loan service will fail. Your lenders will then be able to take other action against you and alternative arrangements must be made.
Through IVA loan service,debts are settled within a reasonable and fixed period of time (normally 5 years). Any interest and debt charges is made frozen and lenders will be prohibited from demanding additional payments from you. Once the decision has been made that an Individual Voluntary Arrangement is right for you, you are asked questions regarding your current financial situation. Based on the information offered by you, a repayment amount will be agreed with you. Once proposals have been drawn up you will need to check and sign these and return them to the Insolvency Practitioner (IP) of your choice.
If the creditor who voted against the IVA loan service represents more than 25% of the total debt you owe the Individual Voluntary Arrangement will fail automatically. This is because an Individual Voluntary Arrangement will only ever be effective if 75% in monetary value is voted for it. If any of the creditors don't vote, it is assumed that they have voted FOR the arrangement.
